Tax Education Seminars for NGOs

Sustainable, effective and efficient
NGOs that comply with relevant laws are important for the fulfillment of the
Millennium Development Goals (MDGs) and the country’s Vision 2030.
As part of
the government’s efforts to enhance NGOs contribution to the foregoing, the
NGOs Co-ordination Board and the Kenya Revenue Authority (KRA) have jointly
organized a series of capacity building workshops for NGOs.
These workshops
are aimed at providing NGOs with relevant information to improve their compliance
and governance and at the same time increase their understanding on the enabling
roles of the NGOs Board and KRA.

NGOs Board holds breakfast meeting with International NGOs
In our effort to improve compliance with legal and regulatory requirements and enhance
our enablement of NGOs; and cognizant of the diversity and distinctive requirements of
the different categories of NGOs, the Board has organised a series of meetings for NGOs
operating in Kenya. The meetings are expected to provide a forum for interaction and
exchange of information between the Board and NGOs.
Towards this end, the Board organised a breakfast meeting with Chief Executives,
Country, and Regional Directors/Representatives of all international NGOs operating in
Kenya on Tuesday, November 9, 2010 at The Hotel Inter Continental, Nairobi.

Cancellation of Registration Certificates
Attention is drawn to the
Notice on the Kenya Gazette No. 15883
dated December 3rd 2010 on intended cancellation of
registration certificates for NGOs that had breached the provisions of
the Non-Governmental Organizations Co-ordination Act, 1990 and violated
the terms and conditions attached to their certificates of registration.
Pursuant to Section 16(2) of the Non-Governmental Organizations
Co-ordination Act, 1990, the NGOs Coordination Board has cancelled the certificates
of registration for 1,229 organizations.
Members of the public, donors, government departments,
banks and other relevant institutions are therefore advised that they
deal with these organizations at their own risk.
All organizations that have been deregistered are required
to return their certificates of registration immediately to the NGOs
Co-ordination Board as provided for under Section 12(4) of the
Non-Governmental Organizations Co-ordination Act, 1990.
The Board would also like to clarify that, contrary
to reports that appeared in sections of the press, Registration and
Deregistration of NGOs is the mandate of the NGOs Co-ordination Board.
The Board does not need approval from any other institution to execute
its mandate.

Nairobi hosts China-Africa NGOs Conference

The first ever China Africa NGO Forum was
held between August 29 and August 30, 2011 at the Crowne
Plaza Hotel in Upper Hill, Nairobi, Kenya.
Some 200 delegates from China and 17
African countries attended the conference aimed at
enhancing collaboration and sharing of experiences
between NGOs in Africa and China.
The conference theme was to Develop
Partnership and Promote Friendship between China
and Africa NGOs.
Kenya’s Vice-President Hon.
Stephen Kalonzo Musyoka opened the conference which
was also attended by dignitaries from governments,
United Nations, inter-governmental and civil society
organization.

High Court reaffirms Board’s powers to
safeguard public interest in the management of NGOs.
The High Court on March 07, 2011 dismissed with
costs the Order of Prohibition sought by
Feed the Children an International NGO seeking
to stop the NGOs Co-ordination Board from investigating
its accounts.
The NGO had argued that the Board does
not have the mandate to review or investigate its financial
accounts and/or demand for documents relating thereto in the
course of such investigation.
Inter alia the main
issue for determination was:
does the NGOs Co-ordination Board have jurisdiction
to investigate financial accounts of NGOs?
On page 14 of the judgment and in response
to the foregoing issue, the learned Judge ruled that the
NGOs Co-ordination Board is empowered to prescribe rules
and procedures for the audit of accounts of NGOs under
Section 24(4) of the NGOs Co-ordination Act. Where the
NGOs Co-ordination Board is of the view that the returns
filed by an NGO are insufficient or contains insufficient
information, it has a right to ask for additional information.
In his ruling Justice
Daniel Musinga found that the Board was mandated under
Section 7 of the NGOs Co-ordination Act to, where appropriate,
conduct investigations. He further said:
"considering that the applicant receives donations
which it holds in trust for the benefit of the intended beneficiaries,
it is against public interest to prohibit the NGOs Coordination Board
from inspecting the applicant’s financial records."
