Public Notice
The Board’s attention has been drawn to reports that NGOs are being directed to pay subscription fees to the NGOs Council or they face deregistration.

The Board wishes to clarify to members of the public, NGOs and other stakeholders that ONLY the NGOs CO-ORDINATION BOARD has the power to suspend or deregister any registered NGOs for violating the law.

The Board has NOT made any resolution in the recent past to deregister any NGO.

The Board wishes to inform all NGOs that membership to the NGOs Council is voluntary.

The Constitution of Kenya provides for the right to Freedom of Association which includes the right to form, join or participate in the activities of an association of any kind.

Inquiries about new NGO law

Many NGO officials have made inquiries about the requirements of the new Public Benefit Organizations Act, 2013. The Board wishes to clarify that NGOs currently registered under the Non-Governmental Organizations Co-ordination Act No. 19 of 1990 will be deemed registered under the new Act.

 

All NGOs will be given one year to comply with the new Act once the Cabinet Secretary gazettes the commencement date.

Charities warned on politics

The NGOs Co-ordination Board wishes to remind NGOs that it is illegal to engage in partisan politics. NGOs are charitable organisations and should use donor funds for charitable and public benefit purposes.

NGO officials using NGO resources to support political parties or candidates will be dealt with according to the law.

However, NGOs can engage in advocacy and/or civic education in pursuit of the objectives for which they were registered.

Security advice to NGOs

The NGOs Co-ordination Board has received inquiries from some international NGOs about the security situation in the country, especially in areas where they are implementing projects. The Board wishes to state as follows:

  1. We are aware that there were pockets of insecurity in Garissa town in Garissa County and Baragoi area of Samburu County in the recent past.

  2. The security agencies have been working round the clock to ensure security is restored in these areas.

  3. NGO staff working in or travelling to these affected areas are urged to be vigilant and seek help and/or advice from security personnel while travelling and while in the field.

  4.  We are monitoring the security situation and are in constant consultation with the security agencies and we shall update NGOs on this matter as necessary.

Minister gazettes new NGO service charges

New service charges for NGOs have been published.

In a special issue of the Kenya Gazette dated November 2, 2012, the Minister of State for National Heritage and Culture, Hon. William Ole Ntimama, amended the Non-Governmental Organisations Regulations, 1992, by deleting the Third Schedule and substituted it with a new schedule.

Effective October 31, 2012, the new charge will be as follows:

Board gets new Executive Director

Dr. Hezron Otieno Mc’Obewa is the new Executive Director of the NGOs Co-ordination Board.

 

He replaces Amb. Peter O. Ole Nkuraiyia, who joined the Constitution Implementation Commission as Secretary/Chief Executive Officer in May.

 

In the Kenya Gazette notice of August 10, 2012, the Minister of State for National Heritage and Culture, Hon. William Ole Ntimama, EGH, MP, appointed Dr. Mc’Obewa to serve for a period of three years effective August 8, 2012.

The Non-Governmental Organizations Co-ordination Board (ISO 9001:2008 Certified) simply referred to as the NGOs Co-ordination Board was established by an Act of Parliament in 1990 and commenced its business on June 15, 1992. The main reason for the creation of the Board was to streamline the registration and Co-ordination of NGOs. Read more

Cancellation of Registration Certificates

 

Attention is drawn to the Notice on the Kenya Gazette No. 15883 dated December 3rd 2010 on intended cancellation of registration certificates for NGOs that had breached the provisions of the Non-Governmental Organizations Co-ordination Act, 1990 and violated the terms and conditions attached to their certificates of registration.

 

Pursuant to Section 16(2) of the Non-Governmental Organizations Co-ordination Act, 1990, the NGOs Coordination Board has cancelled the certificates of registration for 1,229 organizations.

 

Members of the public, donors, government departments, banks and other relevant institutions are therefore advised that they deal with these organizations at their own risk.

 

All organizations that have been deregistered are required to return their certificates of registration immediately to the NGOs Co-ordination Board as provided for under Section 12(4) of the Non-Governmental Organizations Co-ordination Act, 1990.

The Board would also like to clarify that, contrary to reports that appeared in sections of the press, Registration and Deregistration of NGOs is the mandate of the NGOs Co-ordination Board. The Board does not need approval from any other institution to execute its mandate.

High Court reaffirms Board’s powers to safeguard public interest in the management of NGOs.

The High Court on March 07, 2011 dismissed with costs the Order of Prohibition sought by Feed the Children an International NGO seeking to stop the NGOs Co-ordination Board from investigating its accounts.

The NGO had argued that the Board does not have the mandate to review or investigate its financial accounts and/or demand for documents relating thereto in the course of such investigation.

Inter alia the main issue for determination was: does the NGOs Co-ordination Board have jurisdiction to investigate financial accounts of NGOs?

On page 14 of the judgment and in response to the foregoing issue, the learned Judge ruled that the NGOs Co-ordination Board is empowered to prescribe rules and procedures for the audit of accounts of NGOs under Section 24(4) of the NGOs Co-ordination Act. Where the NGOs Co-ordination Board is of the view that the returns filed by an NGO are insufficient or contains insufficient information, it has a right to ask for additional information.

In his ruling Justice Daniel Musinga found that the Board was mandated under Section 7 of the NGOs Co-ordination Act to, where appropriate, conduct investigations. He further said: "considering that the applicant receives donations which it holds in trust for the benefit of the intended beneficiaries, it is against public interest to prohibit the NGOs Coordination Board from inspecting the applicant’s financial records."
